The decision of the Committee of Ministers on the matter of “Kirovles” will be of a recommendatory nature
MOSCOW, 21 sen — news. Vice-speaker of the Federation Council Ilyas Umakhanov in an interview with RIA Novosti said that whatever the decision of the Committee of Ministers of the Council of Europe (CMCE) in the case of “Kirovles”, it still will not be mandatory and have no legal force.
“This decision can have only recommendatory character, and one or the other sovereign state has the right to accept or not to accept”, — said Ilyas Umakhanov.
He also said that even the decisions of the European court of human rights if they conflict with the Constitution, cannot be enforced in Russia.
“Actually, no one would have brought the matter to attention, but around this case once again came up with political environment, political hype, which, of course, is associated with the person of Mr Navalny and others. It is the artificial heating of interest, nothing more,” — said Umakhanov.
In turn, the judge of the ECHR in 1998-2012, member of the Venice Commission of the Council of Europe Anatoly Kovler spoke about how usually the procedure for consideration by the Committee of Ministers of the Council of Europe, various issues: “the Committee watches made the decision on individual measures and adopted measures of a General nature. The Committee appreciates the responses of States. Every Wednesday the carpet caused by representatives of different States and report back. The procedure is quite routine.”
