Russia’s Supreme court proposes the establishment of interregional judicial districts for courts of General jurisdiction, said the President of the Supreme court Vyacheslav Lebedev. “This proposal from the Supreme court will be submitted to the Congress of judges (which will take place at the end of the year),” quotes his words TASS.
“The idea is to change the judicial system of Russia and to the establishment of the five appellate districts of the courts of General jurisdiction to cases that consider in the first instance national, regional, provincial courts of appeal was not appealed to the Supreme court of Russia directly, and in these appellate courts. And to establish nine appellate districts of the courts of General jurisdiction (similar to arbitration courts)”, – he explained.
According to him, this topic has long been discussed, but met with funding. Again, she was raised in the meetings with the delegates of the forthcoming Congress of judges that Vyacheslav Lebedev spent nine judicial districts.
“The conditions for the establishment of such courts and their placement we have available today. I believe that today the conditions have for the establishment of such courts in the system of courts of General jurisdiction. And absolutely right from our point of view to unify the judicial system with courts of arbitration (where there are already such district courts)”, – he noted.
In addition, the reform will not affect the arbitration courts – they “remain in the same model, which operates today,” said Lebedev.
He rejected the possible perception that a change in the judicial system will lead to the need of reappointing all judges of courts of General jurisdiction. “Will be elected or assigned only to those judges in those districts that will be formed. We have calculated for the five courts of appeal will have approximately 170 judges, and appellate districts – 790 judges. The cost of (creating) the courts of appeal, according to our calculations, to 928 million rubles, and for cassation is 3 billion rubles,” – said Lebedev, answering the questions of the judicial pool of journalists.
In the capital region, according to him, the district court may appear “near Moscow.”
“This position of the Supreme court, she will be invited to the Congress,” – said Lebedev. According to him, the reform “will give more guarantees of judges ‘independence, objectivity more”.
“Now in the regional and equal to it, the court appealed the decisions of the district courts and then to the cassation appeal in the same court. Yes, the instance is different, but the court, one team. Therefore, it is reasonable each instance to allow her to be independent,” – said Lebedev.
By estimations of developers of reform, the introduction of the independent interregional district courts creates a complete four-stage court system (courts of first instance, appeal, cassation and Supervisory), because so far these instances are actually combined in one court or in the court of the subject of Russia, or the Supreme. In addition, it will allow you to get away from the territorial binding of the courts to the subject of Russia, when the case is in the courts of one region and only in the end can reach the Supreme court.
