The government of the Samara region at the meeting of August 16, approved the text of the settlement agreement on the suit to recover the principal and interest with the late businessman Boris Berezovsky. About it reports “Interfax”.
The text of the settlement agreement provides recognition for the Samara region debt claims in the amount of 13.5 million pounds.
As explained by the head of the main legal Department of administration of the Governor of the Samara region Vladimir Morgunov, debt Berezovsky in front of the Samara region was recognized by Russian court in 2009, 2010 and 2012. The process for the recognition of the decisions of the Russian courts in the High court of London was not completed due to the death of Berezovsky. “With this in mind, the Samara region from the point of view of British law at present is a contingent creditor with the requirements of one pound sterling”, — he said.
For transforming a conditional debt in real and its collection requires the recognition of the debt of insolvent Trustees of the inheritance of the late businessman, said Vladimir Morgunov. The document must also be approved by the High court in London.
“Thus, the process of recognition of debt in the UK will then be completed and Samara oblast will be able to claim part of the assets of the deceased Berezovsky in proportion to the amount of the recognized debt,” the official concluded.
Earlier, the Russian courts upheld the claim of the government of the region to Boris Berezovsky and its business partner Julia Dubova in the case of LogoVAZ and AVTOVAZ in the amount of 1,063 billion. The region was listed 74 million rubles, after which the remaining debt amounted to 989,4 million rubles.
The claim about collecting of debts from Berezovsky in London’s High court the government of the Samara region sent in September 2012. The businessman, then living in the UK, found the claim unfounded.
Law firm Pinsent Masons LLP, representing the regional interests in the High court in London, despite the death of the defendant in March 2013, continued debt collection. As a result, in 2015 in favor of Samara region was collected about 3 million rubles, in early 2016, 1.4 million rubles, in July 2017 — 5.9 million rubles.
