Inspectors of traffic police will not be Smoking and be rude

Edited in the regulations of the Ministry of interior, there are new rights and responsibilities.

When dealing with drivers, inspectors, traffic police will not smoke and also to prevent “discriminatory remarks based on gender, age, race, nationality” and “offensive remarks”. The relevant provisions of the state traffic Inspectorate is planning to amend the regulations on the supervision of traffic. Experts believe that the provisions of the document will allow drivers to better protect their rights.

On the portal regulation.gov.ru published a new edition of the regulations of the Ministry of interior for supervision of participants of traffic (developed by traffic). Now, recall, there is the old regulations, approved by MIA order No. 185 of 2009. In the spring of 2017 published a draft new instrument (“Kommersant” reported on March 1), after public discussion, it was finalized and sent to the Ministry of economy.

Regulation is essentially an instruction for the traffic police and drivers for interaction with each other.

To stop the car to check the documents (in the absence of any suspicion in committing a violation or crime), the inspectors will now be able anywhere on the road — now it can be done on stationary posts of traffic police.

Under current rules, rights and STS inspector you need to pass without covers, now here comes the clarification — and “without restraint”. It is primarily about the iron chains in which some drivers are tied right so that the inspector took them to his patrol car (in the driver’s slang is called “iron argument”). If the driver refuses to comply with the requirement of the Gai officer, he is entitled to apply article 19.3 of the administrative code, “Insubordination to police requirements” (punishment — till his arrest).

The current regulation says: the conversation with the driver, the employee must be “polite, objective and considerate, to address to the interlocutor on “you”, requirements and observations to present in a convincing and understandable manner, eliminating the possibility of erroneous or ambiguous understanding them, to show calm and restraint”. Will now detail a methodology itself communication. The employee will have to refrain from “any kind of statements and actions that are discriminatory on grounds of sex, age, race, nationality, language, political or religious preferences”.

The inspector is not recommended to behave rudely, to be dismissive tone to be arrogant, to make biased comments.

Not allowed “actions that provoke illegal behaviour”, “offensive language or remarks” and Smoking. New regulations for the first time describes the situation when the driver “tips” the inspector to the abuse of official position and receiving bribes. In this case the employee of traffic police is obliged to submit a notification to the interior Ministry on a special form.

Part of the changes concerns the direct oversight of the movement. Refined, for example, that in the dark and in reduced visibility, a person can have not only the light stick (as of now), but the rod with the “reflective elements”. Clarifies the process check the driver for intoxication: if the medical examination the doctor did not reveal intoxication, the inspectors will be required to return the driver from the hospital to the car.

From the current version of the document disappeared, a part of the innovations planned in the original version. Was, for example, provided the opportunity for inspectors “free to use for official purposes means of communication” belonging to citizens. In addition, the inspectors should have been delivered in branch of “minors who committed offences or anti-social actions, as well as neglected and homeless”. Both these rules are removed in the last version.

Lawyer, expert for traffic safety Katerina Soloveva believes that with the release of the new regulations, motorists will be easier to protect their rights. “Now quite often the drivers, pointing to violations of the provisions of the MIA order No. 185, faced with the fact that judges refuse to take them into account, because the document is internal in nature, she explained “Kommersant”.— The new regulations will expand the definition and concretization of legal relations of the parties, and the courts will have to take this into account”. In the new regulations of the more prominent binding to the demands of the time, said the lawyer of the Society for the protection of the rights of motorists Ravil Akhmetzhanov. “Take one “iron argument” that the drivers were hooked up right to the car, he says. The explanations are detailed, the rights of police officers more chewed thoroughly, several times the necessity of filing reports under part 1 of article 19.3 of the administrative code for failure to fulfill requirements of police officers”.
