The head of the Duma Committee on labor, social policy and veterans ‘ Affairs Jaroslav mil (LDPR) sent an appeal to the two Ministers with a request to include another disease in the list, which can be used as the basis for the release of prisoners, the press service of the Deputy.
The reason for the appeal was the case of wheelchair users Anton Mamaev. The thirtieth of June Timiryazevsky court appointed Mamaev, who because of illness completely atrophied all the muscles, 4.5 years in prison for organizing the robbery. The head of the presidential Council on human rights Mikhail Fedotov has asked prosecutors to investigate whether legally prosecuted.
Mil sent a request to consider the inclusion of the diagnosis of Mamayev in the above list, the Russian health Minister Veronika Skvortsova and Minister of Justice, Alexander Konovalov.
“I ask you to consider the possibility of including the specified diagnosis list of diseases, which can be used as grounds for granting the exemption from punishment of persons convicted to deprivation of liberty, approved by the order of Ministry of the Ministry of health and the Ministry of justice of the Russian Federation of 9 August 2001, No. 311/242”, — reads the statement of the Deputy, a copy of which is available to RIA Novosti.
In addition, the Deputy asked to inform the Committee about the decision.
Previously, RIA Novosti said in the court the severity of the sentence Mamaev: the criminal code does not provide for a collapsible assault in the group of persons the punishment not connected with deprivation of liberty — to solve the question whether the punishment to be executed should the Federal penitentiary service.
The court stressed that the fault of Mamayev in the organization of robbery is proved by the testimony of victims and witnesses, video from surveillance cameras and other data collected during the investigation.
