Defense of the firefighters convicted in the “Winter Cherry” case found violations in the verdict

Lawyers for the firefighters Bursin and Genin, convicted in the Winter Cherry case, appealed against the verdict in the case of “Winter Cherry”, did not agree with the verdict. This is reported by TASS with reference to lawyer Svetlana Tarasyuk.

The defense filed an appeal against the verdict of the Zavodskoy District Court of Kemerovo, noting that the decision was unfair.

According to Tarasyuk, the verdict contains violations Of the Criminal Code of the Russian Federation and the Code of Criminal Procedure of the Russian Federation. In addition, there were inconsistencies in the circumstances of the criminal case.

Earlier, the head of extinguishing the fire in the Zimnyaya Vishnya shopping center Bursin and firefighter Genin were found guilty of negligence and sentenced to six and five years in prison, respectively. The court considered that the crime was caused by the lack of systematic training of firefighters in Russia and weak interaction between various rescue departments.

It was noted that the defense intends to achieve a complete acquittal of the firefighters. According to lawyers, there is no evidence of guilt in the verdict, and the investigation used job descriptions and copies of regulations as evidence of corpus delicti.

The fire in Zimnyaya Vishnya took place on March 25, 2018. 60 people died, including 37 children. Another 79 people were injured. The cause of the fire was a leaking roof – water flooded the lamp, which caused a short circuit. It was found that the fire alarm was not working in the building and the emergency exits were closed.
