Supreme Court: the husband can take half of his salary from his ex-wife even after the divorce after the divorce, it is the common property of the spouses. This is stated in the determination of the judicial collegium for civil cases of the Supreme Court of Russia, RIA Novosti reports.
The Russians were told about the rights to money of spouses after considering a complaint from a resident of Moscow. His wife worked for four years as head of human resources in a company that sells medical devices. The woman found out that part of her salary was underpaid and after the trial she was paid 3 million rubles and another 500 thousand as compensation for the delay. Upon learning of this, the husband of a Muscovite decided that part of the money was due to him, although by that time they had already divorced.
The man filed a lawsuit against his wife, but his case was refused, then he filed a complaint with the Supreme Court. “The property acquired by the spouses during marriage is their joint property,” the definition says. Moreover, the property acquired during the marriage also includes the earned income of the spouses.
Earlier, the Supreme Court of Russia clarified what obligations with respect to property arise for the heirs and ruled that they must fulfill the obligations of the deceased testator. The reason for clarification was the story when the owner of the real estate did not manage to conclude a contract of sale of the object during his lifetime.
