Supreme Court: the private life and dwellings of tenants in Russia are inviolable as a tenant, he confirmed the inviolability of the privacy and home of citizens who rent apartments. “Rossiyskaya Gazeta” writes about this.
The conflict between two Russian women occurred due to a delay in rent. The woman did not give the money on time, and then the hostess, in her absence, came to the apartment and took the expensive laptop belonging to the tenant. At the same time, she promised to return the equipment when the debt is paid. The tenant went to the police with a statement about the theft of the laptop. A criminal case was opened, but the owner of the apartment gave the laptop, and the case was closed.
Subsequently, the tenant filed a lawsuit against the hostess. She asked to compensate her for moral damage from illegal entry into the apartment and taking possession of a laptop, in which personal information was stored. Local courts rejected the claim, and the Supreme Court fully supported the Russian woman.
It was stated that the landlady had infringed on the constitutional right to the inviolability of the home. In addition, the court pointed to Article 152 of the Civil Code, which says that it is impossible to collect, use, store and disseminate information about his personal life without a person's consent. Moral harm can also lie in the experiences of the inability to lead an active social life and job loss, the judges recalled. Meanwhile, the landlady did not return the laptop for nine months. The Supreme Court overturned all decisions of local courts in this case.
Earlier it became known that by 2030 Russia plans to start building up to 5 million square meters of rental apartments annually. The Ministry of Construction also intends to whitewash the rental market by providing tax deductions to tenants and reducing state fees for registering contracts.
