Construction, reconstruction, repair and maintenance of linear facilities will be simplified. The bill introduced by the government of the Russian Federation placed in the electronic database of the lower house of Parliament.
Calculated in accordance with the current legislation term of registration of rights to land plots in state or municipal property, intended for placing of linear objects, is about one year. While existing legal acts oblige organizations who place linear objects, to carry out construction (reconstruction) of facilities for technological connection of facilities of the consumers in period of four months. This difference in timing leads to the fact that a significant portion of the linear facilities are built with violation of the established order.
In this regard, the bill proposes to establish the possibility of placing linear objects in terms of a public easement. In particular, it is proposed to determine the basis for establishing public easement, the appropriate authority of the organs of state power and bodies of local self-government, the rules of formation of legal relations between the owner of land and the person at whose request establishes a public easement.
While restrictions on public servitude in respect of land granted or belonging to the citizens and is intended for individual housing construction, gardening, horticulture, country farms, personal subsidiary farming.
The bill will allow to reduce material and time costs on registration of rights to land plots for the construction, reconstruction, overhaul and operation of linear facilities that will be provided to balance private and public interests in establishing a public easement stated in the explanatory note to the document.
