ECHR: Warsaw has no right to send migrants back to Belarus who find themselves in Poland 
The European Court of Human Rights (ECHR) ruled that the official Warsaw does not have the right to expel migrants who have already crossed the border and ended up on the territory of Poland, back to Belarus. This is stated in the relevant order published on the website.
In the period from August 20 to December 3, 2021, the ECHR examined a total of 47 applications with a request to ensure a safe stay in the territory of the European Union, filed by 198 applicants. Most of them were filed against Poland, whose authorities refuse to provide migrants with asylum, medical care, housing, and so on. According to many applicants, their lives would be in danger if they were sent back to Belarus or to their homeland.
Warsaw opposes accepting migrants who find themselves on the border with Belarus. Mostly those who arrived from the Middle East also note that they are not going to stay on the territory of Poland, but aspire to Germany or other EU countries. However, the Dublin Regulation, adopted in 2013 and in force to this day, states that arrivals can apply for asylum in the country where they first crossed the EU border.
