The decision of the ECHR on the recognition of the discriminatory Russian law banning gay propaganda impossible in Russia, since it contradicts the Constitution. About it RIA Novosti said the Chairman of the Federation Council Committee Andrey Klishas.
“In the form in which it is stated in the decision of the European court, due to its contradiction of the Constitution it was executed can not be”, — said Klishas.
The Senator noted that the decision of the ECHR may violate part 2, article 29 of the Russian Constitution, which deals with banning the propaganda or agitation that incite hatred based on social, racial, national or religious grounds.
Also, in his opinion, there are contradictions with part 3 of article 17 of the Constitution, according to which the exercise of the rights of a citizen must not violate the freedoms of others.
June 20, the ECHR satisfied the claim of group of citizens of Russia Nikolai Baev, Nikolai Alexeev and Alexey Kiselev. The court recognized the violation of their right to freedom of expression and ordered the Russian government to pay activists about 49 thousand euros as compensation for moral and material damages and in compensation costs. The decision was approved by six judges out of seven.
One of the Complainants, Nikolai Alexeyev, said on the air of National news service (NSN) the decision of the ECHR, noting that the state Duma Deputy Vitaly Milonov, “which actively promoted this law in St. Petersburg, lost today”. In this decision the Strasbourg court could be “the beginning of the end” of the ban on gay propaganda in Russia, said the activist.
The Ministry of justice promised to appeal the decision. The Ministry said that the provisions of a number of regional laws banning gay propaganda among minors was not contrary to international practice and were adopted only for the protection of morality and health of children.
