Nationalist Martsinkevich was sentenced to nine years in prison for the attack on drug traffickers
MOSCOW, June 27. /TASS/. Babushkinsky court of Moscow has sentenced on Tuesday to nine years in prison for nationalist and leader of the public movement “Restrukt” Maxim Martsinkevich in the case of attacks on traders spice. About it the correspondent of TASS from the courtroom.
“Recognize Martsinkevich guilty and sentenced him to nine years in prison of strict regime”, — announced the verdict to the judge.
The penalty will be calculated from January 27, 2014. In the near future the court will announce the timing the other nine defendants in the criminal case, participants of movement “Restrukt”.
They are accused of committing crimes stipulated by articles 162 (“Robbery”), 167 (“Deliberate destruction or damage of property”), 213 (“Hooliganism”), 161 (“Robbery”), 111 (“Causing of heavy harm to health, including causing death of the person”) the criminal code of the Russian Federation. Marcinkiewicz was also charged with article 282 (“incitement of national hatred or hostility”) the criminal code of the Russian Federation in connection with his book “Restrukt”, which was recognized as extremist in 2014 and is prohibited. Two defendants in court admitted his guilt in terms of violence, but denied allegations of robbery, seven refused to accept the blame in full.
In addition, according to the court the materials of the case against the accused Alexander Shankin associated with the episode (part 4 of article 111 of the criminal code) on the beating of citizen of Azerbaijan Zaur alisova, who died in the attack, was separated and returned to the Prosecutor for correction of irregularities in the indictment. “Correction of disorders in the course of judicial proceedings is impossible without violation of the rights of the accused,” announced the judge.
The court acquitted a number of defendants in of the episodes due to their wrong skills and also reclassified in the direction of easing the number of episodes of charges.
In the debate of the parties the public Prosecutor asked for the accused a punishment of 3 years and 4 months to 11 years and 6 months imprisonment. The state Prosecutor called for Marcinkiewicz. Assessment the charges “under the guise of public benefit activities of the defendants committed the mercenary and violent crimes.”
The essence of the charges
As found by the court, under the pretext of implementation of socially significant projects related to combating the spread of drugs, in 2013-2014 the accused had made in Moscow attacks on citizens, using as weapons stun guns, pepper sprays and metal batons. They beat the victims, they took possession of their property and to human dignity publicly poured colorants. According trial, Martsinkevich and his accomplices involved in the attacks on eight people, one of them from traumatized died.
Martsinkevich is the ultra-radical activist organizations and one of the leaders of the movement “Restrukt”. He was arrested in January 2014 in Cuba at the request of Interpol and deported to Russia. Kuntsevsky court of Moscow in August 2014 sentenced him to 5 years imprisonment for inciting national and religious hatred, but in November of the same year the Moscow city court reduced the sentence to 2 years and 10 months.
