The case of “Mail of Russia” was forwarded to the Ministry of communications
It the defendant was the clerk, premenopauza Dmitry Strashnov.
As it became known “Kommersant”, the TFR has opened the first criminal case based on prosecutorial inspections revealed the illegal accrual of premiums to the leadership of “Mail of Russia”. It is noteworthy that the first and only person involved in the investigation was not the head subordinated to the Ministry of communications the FSUE Dmitry Strashnov, a senior official of the Ministry — the Director of Department of organizational development Irina Lapteva, who was suspected of excess of powers of office, committed, however, in favour of Mr. Strashnov.
According to “Kommersant”, the first procedural decision on initiation the criminal case on the materials received from the Prosecutor General, received the senior investigator for particularly important cases of the main investigation Department of the TFR Andrey Gilev. For nearly four months, he had discussed in the framework of the preliminary investigation rechecked the data on abuse in FGUP “Mail of Russia” and the Ministry of communications received in the TFR, signed by first Deputy Prosecutor General Alexander Buksman.
Informed the main Department for supervision over execution of Federal legislation, the Supervisory authority pointed out that Ministry officials have approved at the June, 2015 payment of the award to the head of “Mail of Russia” Dmitry Strashnov in size 95,4 mln. the amount was calculated on the basis of the report of the FSUE on the results of work in 2014. The documents were stated net profit “Mail of Russia” — 1.2 billion rubles. However, as stated, the staff of the Supervisory authority, this amount formed only due to the fact that in the reporting year, the Federal state unitary enterprise has received from the budget of 5.4 billion rubles. And in many respects the work of “Mail of Russia” has not achieved planned for the year indicators.
In particular, it was noted that the investment plan the company has not exceeded 57% from the planned. Therefore, according to the Prosecutor General, the prize of the head of “Mail of Russia” was to be not more than 3.2 mln.
With all this also came to light that the appointment of Dmitry Strashnov to the position in 2014 and the conclusion of the contract in contravention of the existing legislation was not discussed so-called value of the possible prize.
All this Mr Buksman wrote in its submission to the investigative Committee, asking to consider the criminal case against Dmitry Strashnov for abuse of power (article 201 of the criminal code) and in respect of two heads of departments of the Ministry of communications, in which he saw signs of negligence (article 293 of the criminal code).
However, the investigator Andrey Gilev has taken quite a different decision. He opened a criminal case against 35-year-old Irina Lapteva, Director of organizational development Department of the Ministry of communications, abuse of office — “making official action is clearly beyond its powers and have entailed essential infringement of rights and legitimate interests of citizens or organizations or legally protected interests of society or the state” (part 1 of article 286 of the criminal code provides till four years of imprisonment).
It is in the competence of Mrs. Lapteva include the establishment of salaries and bonuses to employees of the Ministry of communications and its subordinate organizations
According to investigators, she wrongly gave directives on the payment of Dmitry Strashnova salaries in 2014-2015 in the amount of RUB 46 million and bonuses of 2014 worth over 82 million rubles.
Thus, the TFR changed as required by the Prosecutor’s office qualified the alleged offence and the amount of damages assessed its 128 million rubles.
Moreover, the head of “Mail of Russia” in the case is appears only indirectly, although Andrey Gilev directly pointed out that, in his opinion, Irina Lapteva exceeded his authority in his favor.
Note that in the time of the Commission of the alleged crime Mrs. Lapteva, a psychologist and a lawyer by training, a year and a half worked as the Director of the Department of the Ministry of communications, and previously served as his Deputy. Prior to that, Ms. Lapteva taught, worked as a senior psychologist in the Bank “URALSIB” and was engaged in recruitment in the agricultural Bank.
In this case, further procedural status of Dmitry Strashnov now depends on the testimony of Mrs. Lapteva and expertise, including financial and accounting, which will be assigned as part of the investigation
In addition, as reported by Kommersant, the Prosecutor’s office transferred to the city division RCDS materials on the other “premium business” — payments of 270 million rbl. of awards by results of work in 2014-2015 Dmitry strasnoy his deputies. In this case, prosecutors again found in the actions of the General Director of “Mail of Russia” violation of article 201 of the criminal code. In addition, the Supervisory authority conducts checks of the legality and validity of the FSUE purchase two Tu-204 for shipping parcels to far East, Siberia and East Asia.
In TFR “y” yesterday have confirmed the fact of excitation of criminal case. The Prosecutor’s office declined to comment. According to some, it is due to the fact that Alexander Buksman has not yet received a formal response from the TFR to the address. In the Ministry of communications a criminal prosecution of the head of the Department did not comment.
