The government will discuss a bill to protect the rights of buyers in online

The government of Russia at session on Thursday will discuss a bill aimed at protecting the rights of consumers who purchase goods and services on the Internet, the press service of the Cabinet.

The document proposes to introduce the concept of commodity aggregator and responsibility for the provision of knowingly false information about a product or service and the seller. The bill prepared by the CPS.

“The bill proposes to introduce the concept of “aggregator of goods (services)” as an independent subject of responsibility towards the consumers regarding their rights to information about product (service). Provides for the liability of such aggregators for the actual damage caused by the provision of knowingly false information about the product (or service), the seller (artist, manufacturer, importer) on the basis of which the contract was concluded with the consumer”, — stated in the message.

Now the field of e-Commerce involving consumers are governed by the Civil code (Article 497, “Sale of goods on samples and a remote method of sale of goods”), the law of the Russian Federation “About protection of the rights of consumers” and rules of sale of goods remote way, reminds the Cabinet.

While currently not regulated by the commodity aggregators that not being the actual sellers of goods or providers of services, act as direct recipients of funds from the consumers in significant volumes accumulated by them on their websites.

It is noted that due to the lack of a clear legal regulation of such business entities they actually are outside the jurisdiction of the legislation on protection of the rights of consumers, are not responsible for the observance of the rights of consumers to information about the seller, the manufacturer or the contractor, as well as actually on sold goods and services offered.

This in turn can be used by such market participants in order to obtain the maximum benefit at the expense of economic interests and the legitimate rights of both consumers and honest businesses.

The bill was discussed and approved on March 6 at a meeting of the government Commission on legislative activities.
