The regional court of Penza confirmed the lower court’s decision and refused to restore Cumanacoa, who was on sick leave during the year to 29 sick leave, as a mechanic. On Friday, March 3, reports a press-service of October district court of the city.
Benzenes has addressed in regional court with the requirement to return to work in September 2016, after the chief fired him in April because of absenteeism. Sumarokov argues that the actions of its Manager is illegal as he appeared in the office and explained the reason for his absence sickness.
“The plaintiff from February 2016 until the 8 September he was with various diseases on several sick leaves issued by different doctors in different medical institutions, formally notifying the workplace. In this connection, not informing the employer for a long period of time, no information about his presence at the hospital, the court regarded as an abuse of right”, commented the case in district court.
After refusing to restore it to the position, Sumarokov filed a notice of appeal. In the Penza regional court rejected it as “not found the bases for cancellation or change of decision in connection with which it entered into force.”
