Prosecutors will be able to send Russians to the asylum through the court
The state Duma adopted in the third reading the law assigns public prosecutors the right to appeal to court with the claim about compulsory hospitalization of citizens to a mental hospital. About it reports “Rosbalt”.
At the moment, the representatives of the Supervisory authority is not entitled to apply directly to court with such a claim, it can make the doctors in the hospitals, including on the proposal of the Prosecutor.
“As a rule, courts satisfy such claims, however, in some cases refused, citing the absence of procedural legislation direct reference to the right of the Prosecutor to present administrative claims in this category,” — said in the message.
In the state Duma explained the necessity of adoption of amendments, in particular, the fact that many individuals currently evading treatment.
