Moscow. 27 Nov. INTERFAX.RU — Russia’s Supreme court proposes not to punish citizens who illegally bought a special technical means for secret obtaining of information, if it was advertised as a household or acquired for security purposes.


“To explain to the courts that the mere fact of illicit trafficking of special tehsredstv can’t testify about a person’s guilt in committing a crime provided by article 138.1 of the criminal code, if his intent was not aimed at the acquisition or the sale of such funds. For example, a person using a public Internet resource has become the special technical facility, touted as the device for household purposes, and erred in good faith regarding its actual purpose”, — is spoken in the draft of the Plenum of the Supreme court.

Also the armed forces notes that can not be brought to criminal responsibility the persons who have acquired a “spy” device to use, for example, for personal safety, the safety of family members, including children, the safety of property or for the purpose of tracking animals and not supposed to use it as a means of infringing on the constitutional rights of citizens.NewsSpy equipment leave at home

In the draft of the Plenum also clarified that the meaning of the law, the smartphones, voice recorders, video recorders and similar devices, can be considered of special technical means only under the condition, “if they deliberately by special technical revision, programming or otherwise imparted new qualities and properties that allow you with them to secretly obtain information.”

Article 138.1 of the criminal code (trafficking of special technical means intended for secret obtaining of information) assumes punishment from the penalty to 200 thousand roubles before imprisonment for the term up to four years.
