The verdict in the case of the East: the real terms and billions of dollars in payments
Far East district military court in Khabarovsk on Monday sentenced the participants in the case of abuse during the construction of the Vostochny space centre — they got from 5.5 to 12 years in prison and fines of up to 1.5 million rubles. With two members of the court ruled in favor of Roscosmos 5.1 billion rubles. Lawyers condemned have declared the unreasonableness of the verdict and intends to appeal.
Among the prisoners is the former head of “Dalspetsstroy” (now GVSU No. 6) Yuri chrisman, his son — entrepreneur Michael Chrisman, chief accountant of “Dalspetsstroy” Vladimir Ashikhmin and former speaker of the Khabarovsk regional Duma Viktor Chudov.
The trial began in may 2016 and was held behind closed doors, as the materials before the court were a state secret. Monday, 26 February, the journalists were allowed to attend the announcement of a productive part of the sentence.
Crime and punishment
According to investigators, in 2006-2009, the accused, acting in an organized group, kidnapped about 106 million rubles, belonged to the “Dalspetsstroy”. As claimed SK, Yuri chrisman and chief accountant of the enterprise Vladimir Ashikhmin, abused official powers with the use of advances by 11 state contracts for purposes not connected with construction of the Vostochny space centre, which resulted in a damage of the Russian Federation almost 5.2 billion.
According to the verdict, Yuri chrisman convicted of two counts of crime under article “Abuse of power” and “Embezzlement by an organized group” he appointed 12 years of imprisonment in a General regime colony and a fine of 1.5 million rubles.
Ashikhmin found guilty under the article “Abuse of power”, he was sentenced to seven years of imprisonment in a General regime colony.
Michael Chrisman was found guilty under article “Embezzlement by an organized group,” he was sentenced to five years and six months imprisonment with a fine of 800 thousand rubles.
Chudov was found guilty under article “Embezzlement by an organized group,” he was sentenced to six years imprisonment and a fine of 900 thousand rubles.
In addition, the court was satisfied civil suits.
“In favor of GVSU No. 6 (former “Dalspetsstroy”) and George Michael Hismanal solidarity in order collected of 26.39 million rubles. With Yuri Chrisman and Victor Chudov solidarity in order recovered 60.2 million rubles. Lawyers will appeal the verdict
Lawyers of the former head of “Dalspetsstroy” Yuri Chrisman and former accountant of the enterprise Vladimir ashikhmina intend to appeal the verdict to the Supreme court.
“Protection uniquely considers the sentence unjustified and illegal and we will appeal against in an appeal order. It is the Supreme court Collegium on military cases”, — said journalists the lawyer Chrisman Sr. Igor Anisimov.
He also stressed that there was no damage to the Russian space Agency and GVSU No. 6 (formerly “Dalspetsstroy”) was not.
“We have tried to provide all court documents stating that no prejudice in fact is not, and this justified the innocence of my defendant and other participants in the process. But the court did not take them into account. As a lawyer, I don’t understand how you can render a verdict of guilty despite the fact that in business there are documents about the absence of damage”, — said Anisimov.
He explained that the defense invited the expert, honored economist of the Russian Federation, which on the basis of documents “Dalspetsstroy” did their own calculations, the alternative presented by the investigators. “He proved mathematically that there is no damage. Talking about this and documents that they did not take illegal decisions”, — said the lawyer.
