The state Duma expects to humanization
How the new law will affect the fate of the accused in the crime.
Defendants and suspects, the court may prohibit to drive or leave the house, — a law adopted in the third final reading the state Duma. In addition, the court may prohibit the presence in any places, events, and communication with certain people. Also, suspects can limit the use of the Internet and means of communication.
According to the author of the bill, the Deputy Ilya Kostunova, such restrictions will ensure compliance with human rights and increase the effectiveness of criminal prosecution.
“The purpose of the bill — humanization of our justice system at the stage of preliminary investigation, because when a person is a suspect, it is impossible to prevent an excessive for its limitations and hardships, because his guilt is not proven, and sometimes mistakes. Unfortunately, today’s practice is that it is much easier to send a man to the detention facility, to deprive him of his liberty than to use alternative measures such as house arrest or a preventive measure not connected with imprisonment” — said Ilya Kostunov.
The bill introduces additional ways to provide the opportunity for the investigation to establish all the facts, prepare the case for transfer to the court, minimal way limiting the civil rights of the suspect.Ilya Kosmonauta
New enforcement actions will contribute to humanization of the criminal legislation, the leader of the movement “For human rights” Lev Ponomarev. However, according to him, there is a danger that judges do not use the innovation: “Will this decrease the number takes into custody? I don’t believe it. If the judges will give appropriate recommendations and they will take new measures adopted, and the investigators would not require detention, then I welcome it. This is not happening for the first time. What is the problem of our deputies?
Even if parliamentarians take some laws that are aimed at humanization, they then do not watch how they performed.
