In Russia, they proposed to ban eviction from mortgage apartments on one condition

Children's Ombudsman Volynets: it is necessary to prohibit the seizure of housing purchased for matkapital from apartments purchased with maternity capital funds. This is reported by RT with reference to a copy of the relevant appeal sent by the children's ombudsman to the Minister of Labor and Social Protection Anton Kotyakov.

As Volynets noted, when buying real estate for materiel, parents are obliged to give their children shares in the dwelling – this guarantees minors the right to housing. But when all family members are evicted, this guarantee actually loses its meaning, the commissioner said.

Volynets stressed that the presence of children from the evicted citizens is not an obstacle to the withdrawal of mortgage housing. In her opinion, it is necessary to initiate amendments to the federal law “On mortgages (pledges of real estate)” and to the Civil Code in order to protect the rights of children of mortgagees.

The Ombudsman believes that one condition on the use of mother capital when buying a home is enough to ensure the impossibility of eviction of the family. Currently, the law prohibits depriving citizens of their only housing, but this norm does not apply to mortgage apartments.

Earlier, Volynets proposed to introduce in Russia annual payments to large families in the amount of 100 thousand rubles until the youngest of the children reaches the age of majority or ends them school, secondary or higher education institution. She said that this measure of social support may be included in the federal law “On the status of large families” after it is adopted.
