The constitutional court will make a decision about the payment of Northern allowances in excess of the minimum wage
St. PETERSBURG, 7 Dec — RIA Novosti. The constitutional court of Russia (COP) on Thursday will announce judgment in the case on verification of constitutionality of provisions of the Labour code of the Russian Federation, allowing not to pay employees Northern allowance in addition to the minimum wage.
The applicants in the case are four women in the Northern regions of Russia from Republic of Karelia, Irkutsk region and the Altai territory. As they say in court materials, the calculation of salaries of the applicants regional coefficient and percentage allowance for work in areas with special climatic conditions shall be included in the minimum wage.
The courts dismissed the applicants in terms of salary allowances that, in their opinion, should be accrued in excess of the statutory minimum wage. The applicant appealed against in KS articles 129, 133 and 133.1 of the Labour code of the Russian Federation.
“According to the applicants, allowing for the inclusion of Northern allowances in the minimum wage, the contested provisions violate the principle of the social state and the constitutional principle of equality, because employees who work in adverse conditions, are the same social guarantees as other employees”, — stated in the materials of the court.
