The Ministry of health has developed a form of certificate of sex change

Form of certificate of sex change for submission to the Registrar available for public comment. The legislation this rule appeared in 2013, however, due to the absence of a decision of the Ministry of health, applicants had to go to court.

The Ministry of health published a draft order “On approval of the form and procedure of issuing medical organization of the document confirming ‘change of sex”. The document can be found on the portal of projects of normative legal acts.

In the explanatory note to the draft States that the project is developed in accordance with the law “On acts of civil status”, which provides for the introduction of the documents upon submission of a document confirming ‘ change of sex, which should issue a medical organization.

To establish sexual reorientation should be a permanent medical Commission consisting of a psychiatrist, the doctor-sexologist and clinical psychologist.

Moreover, the medical Commission will be able to make only two decisions: to issue a certificate or deny a certificate.

“The establishment of sexual reorientation may be issued by a psychiatrist on the results of medical surveillance, a period which is not less than one and a half years”, — stated in the draft order. It is expected that the certificate will be valid for one year from the date of its issue.

Amendments to the law on registry office were adopted in 2013. In article 70 of the law “On civil status acts” was introduced a clause stating that the entry of a civil status act can be amended on sex change on the basis of a document issued by a medical organization. However, the Ministry of health has still not approved the form of this document and the Registrar refused to accept the medical certificate is not approved form, which forced the applicants to get their way through the courts.

It is expected that the order will come into force in January 2018.
