The constitutional court of Armenia rejected the claim of the successors of the killed Russian soldiers families to 450 thousand Euro

Moscow. 3 Oct. INTERFAX.RU — the constitutional court of Armenia has terminated the proceedings under the claim of the successors of the killed Russian serviceman Valery Permyakov in Gyumri family Avetisyan.

As reported on the website of the constitutional court, the decision was made on September 27. According to the decision, the claims should be dismissed because the plaintiffs, challenging the constitutionality of the provisions of the act, raise the question of the legality of its use or has other purposes.

In may, the lawyers of the aggrieved party in the case Permyakova appealed to the constitutional court of Armenia. “The appeal is presented may 17. It relates to the legislative provisions in relation to representation by counsel in a civil suit for the murder of the Avetisyan family,” said the lawyer Aramazd Kivirian.

According to him, the successors on the basis of a civil lawsuit demanded compensation for material damage in the amount of 450 thousand euros.

“The court of first instance refused to accept the suit. Appeal and cassation courts upheld the decision without review. Therefore, we appealed to the constitutional court on the part of the legislation creating this position,” said Kivirian.

Previously, the successors to the injured party submitted to the constitutional court of Armenia the complaint, considering that the crime is solved, not completely, but Permyakov could not act alone. Later in another complaint, the successors demanded compensation for material damage in the amount of 450 thousand euros.

August 23, a court in Armenia Permyakov was sentenced to life imprisonment for the murder in Gyumri on January 12, 2015, seven members of the Avetisyan family, including two young children.

August 12, 2015 at garrison court in Gyumri Permyakov admitted guilty under three articles of the criminal code — desertion, theft of weapons and their illegal possession, and sentenced him to 10 years in strict regime colony. The case has been allocated from criminal case about the murder in Gyumri.

Permyakov was transferred to Russia to serve his life sentence.
