The bill denying citizenship of the Russian Federation to the terrorists in the state Duma passed the first reading

Moscow. May 19. INTERFAX.RU — the state Duma adopted in the first reading a bill that gives the state the right to cancel the earlier adopted decision on the granting of citizenship to foreigners if they turned out to be terrorists and were condemned for it by the court.

At the same time to revoke the citizenship of a person who is a Russian citizen by birth but he devoted his life to terrorism, will continue to be impossible.

The bill was initiated after the terrorist attack on 3 April in St. Petersburg metro — the man who committed it was, according to the investigation, the foreigner who has been granted Russian citizenship.

The authors of the bill were made by the speaker of the state Duma Vyacheslav Volodin and the leaders of the four factions — Vladimir Vasilyev (United Russia), Vladimir Zhirinovsky (LDPR), Gennady Zyuganov (Communist party) and Sergei Mironov (“Fair Russia”) and the first Vice-speaker Ivan Melnikov (Communist party), Deputy speaker Igor Lebedev (LDPR) and Irina Yarovaya (“United Russia”), head of the Committee on state construction and legislation Pavel Krasheninnikov and the first Deputy head of the faction “socialist” Mikhail Yemelyanov.

The bill provides for cancellation of the decision on acquisition of citizenship of the Russian Federation of persons convicted on terrorist and extremist articles of the Criminal code.

In accordance with the current law on citizenship of the person who filed the statement with the request for granting citizenship of the Russian Federation, is obliged to observe the Constitution of the Russian Federation and the legislation of the Russian Federation. At the same time the current law determines that the repeal of the decision on acquisition of citizenship of the Russian Federation may be, if such person has submitted false documents or provided false information when entering into citizenship.

These existing rules of admission to citizenship, and repelled the authors of the bill in its preparation. The bill proposes to understand the communication of false information upon entry into the citizenship of the reluctance of such person to comply with the Constitution of the Russian Federation and the legislation of the Russian Federation, if it is confirmed the court decision and condemnation of this man for a number of criminal charges.

Among these criminal charges is an article about the encroachment on life state or the public figure, violent seizure of power, armed rebellion, attack on persons or institutions that enjoy international protection, if these crimes were connected with terrorist activities.

Also reasonable to assume that the person was not going to comply with the Constitution, his judgment will be according to the articles of the Criminal code: an act of terrorism, assisting terrorist activities, public calls to terrorist activity or public justification of terrorism through the media or Internet, and receive training in terrorist activities, organization of terrorist community and participation, the organization of activities of a terrorist organization and participation in the activities of an organization, an act of international terrorism.
