In the state Duma introduced a bill on criminal responsibility for bride kidnapping

MOSCOW, April 26 — RAPSI. The national Assembly of the Republic of Ingushetia in the Duma introduced a bill according to which proposed to establish criminal liability for kidnapping with the purpose of marriage, stated in the electronic database of the lower house of Parliament.

The criminal code (CC) of the Russian Federation proposed to add article 126.1 of “Kidnapping with the purpose of marriage”. For such crime the authors of the bill want to establish punishment in the form of compulsory works or deprivation of liberty for a term up to three years.

The explanatory Memorandum States that the action of kidnapping with purpose of marriage, in practice, fall under article 126 of the criminal code. However, the perpetrator in most cases it is possible to avoid criminal liability on the basis of the notes to this article, according to which a person who has voluntarily freed a kidnapped, is released from criminal liability if his actions do not contain structure of other crime.

“This situation is due to the fact that the legislator when drafting the criminal code of 1996 did not include this offence in the new criminal law, being guided, apparently, by the fact of dissemination of abduction with the designated motif on a limited part of the territory of the Russian Federation and in the republics of the North Caucasus. However, this position does not seem to be correct, because the Republic is not entitled to establish responsibility for the act, since according to the Constitution the criminal law is administered by the Russian Federation”, — stated in the document.

As a result, as indicated by the parliamentarians, the law enforcement authorities of these republics can not bring the kidnappers to justice.

The victim side, finding no protection from the state, often trying on their own to repair the damage from the insult, and so is the kidnapping of women by local customs.

This poses a real threat to judicial resolution of conflict, which can affect innocent (for example, relatives of the kidnapper or kidnapped).

Furthermore, this situation detracts from the credibility of public authorities, which in this case forced to withdraw from participation in the conflict resolution.
