Protection opposition activist Ildar Dading, who is serving a sentence in prison for violating the rules of holding rallies, petitioning for cancellation of the sentence. On Monday, February 13, reports “Interfax” with reference to the lawyer Ksenia Kostromina.
“Today I sent a petition to the President of the Supreme court Vyacheslav Lebedev on the initiation of Supervisory review proceedings for the abolition held judgments against Ildar Dading” — said the lawyer.
In the motion, the defense also requests the immediate release of the Dading from custody.
10 February, the constitutional court (CC) decided to review the case, the Dading. The court decided to refuse from criminal responsibility for repeated violation of the formal rules of conducting meetings. “Criminal liability may be imposed only in case if the act caused harm to citizens, public security and other values”, — said the Chairman of the COP Valery Zorkin.
At the moment the activist is kept in IK-5 in Altai Krai, where he was transferred in January from colony No. 7 in Segezha. In FSIN declared that it was done for personal security of the convicted person. In November 2016 Dading complained about the beatings in the IR-7, but the check conducted by the regional Investigation Committee of the violations of the rights of opposition was revealed.
The dading was sentenced to three years imprisonment under article 212.1 of the criminal code providing responsibility for violations during public events. He was found guilty on four counts of participation in uncoordinated protests and was serving a sentence in colony of General regime. In March 2016 the defense managed to reduce his sentence to 2.5 years.
