The state Duma introduces fines for dangerous driving in the amount of 5 thousand rubles

The state Duma adopted on Friday in the first reading the government draft law on the introduction of penalties in the amount of 5 thousand rubles for dangerous driving.

The deputies made amendments to article 12.38 RF code of administrative offences (administrative code), which establishes “administrative responsibility in the form of a fine in the amount of 5 thousand rubles for committing the driver of the vehicle actions defined as dangerous driving”. In the accompanying documents to the draft law explains that the need for the introduction of sanctions for dangerous driving is dictated by the changes in traffic rules (SDA), which explicitly prohibits this riding style.

In the explanatory note it is reminded that at the end of may 2016 the government has introduced the SDA concept of “dangerous driving”. It is expressed “in committing one or more successive actions, namely the failure of the rebuilding of the requirement to give way to the vehicle having the priority right of movement, changing lanes in heavy traffic when all lanes are busy, except in the case of left turn or right turn, stop or detour obstacles, the failure to observe a safe distance to the vehicle ahead and lateral spacing, heavy braking, if braking is required to prevent an accident, obstruction of overtaking, if these actions caused the creation of a driver in traffic situations in which his movement and (or) the movement of other traffic participants in the same direction and with the same speed creates threat of death or injury of people, damage to vehicles, buildings, goods or causing other material damage.”

“Dangerous driving in some cases deprive other road users of the ability to predict the future behavior of the driver, and to react to it in order to avoid the creation of an emergency”, – say the developers.

Profile Committee of the state Duma on state building and legislation – fully supported the concept of a government initiative. In addition, his first Deputy Vyacheslav Lysakov proposed to tighten administrative responsibility for the recurrence of dangerous driving. According to him, in case of committing new offenses within a year it is necessary to provide “administrative detention, correctional work, deprivation of rights for a long time”. The relevant amendments he promised to prepare for the second reading of the draft law.

A broad public discussion of the amendments to the traffic rules, introducing the term “dangerous driving”, passed on March 31 last year on the instruction of Prime Minister Dmitry Medvedev in format of Open government with the participation of experts, representatives of relevant departments, public organizations, and insurers. The need for the introduction of the concept of “dangerous driving” was supported by all panelists, however, the experts made a number of proposals to clarify the wording and possible evidence of a violation.
